Trial Courts Sometimes Make Mistakes AND Justice Must Await an Appeal

The trial court did not award wife any share of the parcels of real property, of a home equity line of credit husband took after commencement of the action, or of money withdrawn by husband from his life insurance policy after commencement of the action. The Supreme Court also failed to award wife a portion of a 2005 tax return and made her maintenance taxable.

Joint Custody Agreement Not Maintained Where Parents Are Antagonistic

The parties had joint legal custody with mother having sole physical custody and father having visitation every weekend and every Wednesday. The family court rejected father’s petition to modify custody to award him sole custody, but granted mother’s petition to award her sole custody and reduce father’s visitation to every other weekend.

It Doesn't Pay to Try to Fool the Court

Justice Robert Ross, sitting in Nassau Supreme Matrimonial Court, has ordered that a hearing be held in order to ascertain whether Mr. Eyal Cohen had more money and assets than he disclosed in his Net Worth Statement to the Court in requesting a Court-Ordered attorney. When the case was settled, and Mr. Cohen agreed to pay his wife $45,000.00, the settlement agreement showed diamond sales, other business-related income and assets that were not previously disclosed.

Social Security Disability Is Not Determinative on the Divorce Court

The Courts have held that even though one is receiving Social Security disability benefits, that in of itself does not preclude the Divorce Court from finding that a person is capable of working.

Child Support or Maintenance Affects Ability to Obtain Mortgage

Child support or maintenance payments may qualify in obtaining a mortgage or refinance. When a borrower has been receiving full, regular, and timely payments for alimony or child support or maintenance for 12 months, the income is considered stable income.
