Change of Residence or Moving
Once a divorce or separation agreement is finalized and a pattern of sharing the parenting has become established, one of the most difficult circumstances to deal with is if one or both parents wish to change their place of residence. Change of residence is often necessitated by job requirements, remarriage, or desire to relocate to another city or state. The move could be a relatively minor one or it could be over a great distance. Obviously, if one parent has to move a long way it creates problems which are more difficult to deal with than if the move is a relatively short one.
As with the initial determination of custody, a relocation issue will be a function of the best interests of the children. A relocation case may often include a law guardian, forensics and a hearing.
